A woman in her thirties faced imprisonment after leveling false accusations of rape against her biological father, a man who had previously funded her overseas studies. This accusation arose from a financial dispute, as he had declined her request for money.
As reported by the legal sector on the 1st, the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, with Presiding Judge Choi Chi-bong at the helm, recently handed down a 10-month prison sentence to a woman identified only as A. She was convicted on charges including defamation, business obstruction, and insult.

The accused, referred to as A, was taken to court after making 11 online posts from May to June of the previous year. These posts, titled "I am a victim of familial sexual violence. Please look at this," were aimed at defaming her own father, B.
Within these posts, she falsely alleged, "I have been subject to ongoing sexual abuse by my biological father since I was four years old, and my mother also endured domestic and sexual violence," "The matter was resolved with a compensation of 30 million won," and called for "Severe punishment is necessary."
In her campaign, A disclosed B's true identity and his business details, reportedly causing significant disruptions to his business operations.
Moreover, A accused B of remarrying a woman, C, with whom he had supposedly engaged in an extramarital affair, making six separate online claims about this situation.

In February 2021, A initiated a lawsuit at the Incheon District Court, seeking damages for alleged sexual assault by B. However, she was unable to substantiate any unlawful conduct with evidence.
During the criminal proceedings, A maintained the authenticity of her statements, but the court dismissed her assertions, referencing the lawsuit's outcome. The court noted the absence of corroborative evidence or circumstances supporting A's claim of habitual sexual assault by B.
Furthermore, the court assessed A's accusations as baseless, considering B's financial support of her educational aspirations abroad and upon returning home. Her rape allegation coincided with an unfulfilled request for a significant sum intended to establish a café, which B had declined to provide.

The court underscored, "These false accusations were made as an expression of discontent over the refusal of financial help, severely tarnishing the reputations of the victims, which remain irreparably damaged."
In explaining the rationale behind the sentencing, the court remarked, "Taking into account the high probability of A reoffending, as she persists in publishing similar content post-crime, alongside the victims' fervent calls for stringent punishment, these elements were thoroughly considered."
